DwellSoul, LLC, a Washington limited liability company, operates dwellsoul.com and related websites, mobile experiences, reports, products, features, and services that link to this Privacy Policy, collectively, the “Service.”

This Privacy Policy explains how DwellSoul, LLC (“DwellSoul,” “we,” “us,” or “our”) collects, uses, shares, stores, protects, and otherwise processes information about users of the Service.

This Privacy Policy is intended for users in the United States and other jurisdictions where the Service is lawfully available. Privacy rights and obligations may vary depending on your location. Where required by applicable law, additional rights or disclosures may apply to you.

If you do not agree with this Privacy Policy, do not use the Service.

1. Who We Are

DwellSoul provides software-based, informational, educational, and tradition-based home readings. The Service may apply selected principles from traditions such as Chinese Feng Shui, Korean Pungsu, Vietnamese Phong Thủy, and other traditions we may add over time.

DwellSoul is not a real estate brokerage, lender, mortgage broker, loan originator, law firm, financial advisor, medical provider, construction contractor, home inspector, architect, engineer, or licensed professional advisory service.

For privacy purposes, DwellSoul generally acts as the controller or business responsible for the personal information we collect through the Service.

2. Information We Collect

We collect information in several ways: information you provide to us, information generated through your use of the Service, information from third-party services or public sources, and information we receive when you request a Partner introduction.

2.1 Account and Contact Information

2.2 Property and Home Information

To generate readings and reports, we may collect:

  • Property address
  • City, state, country, postal code

  • Lot, building, room, layout, or floor-plan details
  • Front-door direction or orientation
  • Surrounding environment information
  • Photos, floor plans, screenshots, or other files you upload
  • Notes or answers you provide about a home

Some property information may relate to your residence and may therefore be personal information.

2.3 Birth Data and Tradition-Related Intake Information

Some DwellSoul features may request optional birth-related or tradition-related information, such as:

  • Birth date
  • Birth time
  • Birth location
  • Gender or household-role information, if relevant to a feature
  • Household member or family profile information
  • Tradition preferences, such as Feng Shui, Pungsu, Phong Thủy, or other tradition selections

We treat birth date, birth time, birth location, and household/family intake details as sensitive intake information within DwellSoul, even where applicable law does not classify all of it as “sensitive personal information.”

You should not submit another person’s birth data or family information unless you have that person’s permission or another lawful basis to do so.

2.4 Generated Reports, Scores, and Inferences

The Service may generate:

  • Spirit Scores
  • Reading summaries
  • Tradition-based observations
  • Suggested remedies or educational notes
  • Property comparison notes
  • Saved reports
  • Shareable images or report excerpts
  • Inferences based on your intake answers, property data, and selected traditions

These generated outputs may be linked to your account, property, or intake information.

2.5 Payment Information

Payments are processed by Stripe or another payment processor identified at checkout.

We may receive limited payment-related information, such as:

  • Payment status
  • Plan purchased
  • Subscription status
  • Billing history
  • Last four digits of a payment card
  • Payment method type
  • Stripe customer or transaction identifiers

We do not intentionally store complete payment card numbers.

2.6 Partner Introduction Information

If you request an introduction to an independent third-party Partner, such as a real estate agent, financing professional, tradition consultant, designer, contractor, or home-service provider, we may collect and process:

  • Your name and contact details
  • Your location or service area
  • Property-related information
  • Intake answers relevant to the request
  • Service category requested
  • Partner matching preferences
  • Messages or notes you submit for the Partner

Partner introductions are also governed by our Partner Introduction Disclosure.

2.7 Communications and Support Information

If you contact us, respond to surveys, provide feedback, or participate in promotional or research activities, we may collect:

We do not guarantee that public or third-party data is accurate, complete, or current.

3. Information We Do Not Intentionally Collect

DwellSoul does not intentionally collect:

  • Social Security numbers
  • Government ID numbers, unless required for a specific verified process
  • Full payment card numbers
  • Medical records
  • Health insurance information
  • Biometric identifiers for identification
  • Children’s information from children under 13
  • Precise GPS location unless you choose to provide it or allow device-location access

Do not submit health, medical, financial-account, government-ID, or other highly sensitive information unless we specifically request it for a lawful and clearly explained purpose.

DwellSoul is not a health or medical service. We do not intentionally collect consumer health data or use the Service to diagnose, treat, predict, or manage health conditions. If DwellSoul later offers features that may involve health-related data, we will provide any additional notices, consents, or policies required by applicable law before collecting or using that information.

4. How We Use Information

We may use personal information for the following purposes.

4.1 Provide and Operate the Service

We use information to:

  • Create and manage accounts
  • Generate Spirit Scores, readings, reports, and summaries
  • Save homes, profiles, and reports
  • Provide paid plans and subscription access

4.2 Personalize and Improve the Service

  • Remember your saved homes and preferences

Birth data and sensitive intake information will be used only as described in this Privacy Policy and will not be used in identifiable form for unrelated advertising.

4.3 Generate Automated or AI-Assisted Outputs

The Service may use automated tools, algorithms, AI-assisted systems, or third-party technology providers to generate or support readings, summaries, explanations, and other outputs.

These outputs are informational only. They do not produce legal, financial, lending, real estate, medical, construction, or other professional decisions.

We may use de-identified, anonymized, or aggregated information to evaluate and improve automated outputs, provided such use is permitted by this Privacy Policy and applicable law.

4.4 Process Payments and Subscriptions

We use payment and subscription information to:

4.5 Partner Introductions

If you request a Partner introduction, we may use your information to:

  • Facilitate the introduction
  • Track whether the introduction was completed
  • Provide support regarding the introduction process

We do not share your birth data with Partners unless it is necessary for the requested service and you authorize or direct us to share it.

  • Marketing communications, where permitted by law

You may opt out of marketing emails by using the unsubscribe link or contacting us. You may still receive non-marketing service and legal messages.

For users in jurisdictions requiring a legal basis, such as the European Economic Area, United Kingdom, Switzerland, or similar jurisdictions, we process personal information under one or more of the following legal bases:

  • Contract: to provide the Service, reports, accounts, paid plans, billing, support, and requested Partner introductions.
  • Consent: where we ask for consent, such as for certain cookies, optional birth data, certain marketing, or certain sensitive information.
  • Legitimate interests: to improve the Service, secure the Service, prevent fraud, understand usage, conduct limited analytics, and operate our business, where those interests are not overridden by your rights.
  • Legal obligation: to comply with tax, accounting, consumer protection, legal process, and other legal requirements.
  • Vital interests or public interest: only where applicable and legally appropriate.

You may withdraw consent where processing is based on consent, but withdrawal does not affect processing that occurred before withdrawal.

6. Special Treatment of Birth Data and Sensitive Intake Information

Because DwellSoul may request birth date, birth time, birth location, or household-member information for certain tradition-based features, we apply additional internal limits to that information.

6.1 How We Use Birth Data

We may use birth data and sensitive intake information to:

  • Generate requested readings or features
  • Personalize tradition-based observations
  • Save profiles if you choose to save them
  • Provide customer support
  • Maintain security and prevent misuse
  • Improve the Service using aggregated, anonymized, or de-identified information
  • Comply with law

6.2 How We Do Not Use Birth Data

We do not use birth date, birth time, or birth location in identifiable form for unrelated advertising, sale, or disclosure to data brokers.

We do not share identifiable birth data with real estate agents, lenders, financing professionals, contractors, or other Partners unless you specifically request or authorize that sharing for a relevant service.

We do not use birth data to make lending, credit, employment, insurance, housing eligibility, tenant screening, medical, or other regulated decisions.

6.3 De-Identified and Aggregated Use

We may use information derived from birth data or other User Content in aggregated, anonymized, or de-identified form for analytics, product development, research, quality improvement, and business purposes.

We will not attempt to re-identify de-identified information except as necessary to test or maintain de-identification safeguards, comply with law, or investigate misuse.

6.4 Deletion of Birth Data

You may request deletion of birth data associated with your account, subject to legal, security, billing, backup, and legitimate retention needs.

Where feasible, DwellSoul should provide account-level controls allowing users to delete saved profiles, birth data, and family-member information.

7. How We Share Information

We may share personal information as described below.

7.1 Service Providers and Processors

We may share information with vendors and service providers who help us operate the Service, including:

  • Hosting providers
  • Cloud storage providers
  • Payment processors
  • Email and communications providers
  • Analytics providers
  • Security and fraud-prevention providers

  • Mapping and geocoding providers

These providers are authorized to process information only for permitted business purposes and are expected to protect the information they process for us.

Payment information is processed by Stripe or another payment processor identified at checkout. Payment processors may collect and process payment information according to their own terms and privacy policies.

7.3 Partner Introductions

If you request a Partner introduction, we may share your contact information, service request details, property-related information, preferences, intake answers, and other information reasonably necessary for the Partner to contact you and understand your request.

Partners are independent third parties. Their own privacy policies and practices apply after your information is shared with them or after you provide information directly to them.

7.4 Legal and Safety Disclosures

We may disclose information if we believe disclosure is reasonably necessary to:

  • Comply with law
  • Respond to lawful requests or legal process
  • Enforce our Terms of Service
  • Protect DwellSoul’s rights, property, or safety
  • Protect users, Partners, or the public
  • Investigate fraud, abuse, or security incidents

7.5 Business Transactions

If DwellSoul is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, personal information may be transferred as part of that transaction, subject to appropriate safeguards where required by law.

7.6 Aggregated or De-Identified Information

We may share aggregated, anonymized, or de-identified information that does not reasonably identify you.

7.7 Sale or Sharing of Personal Information

As of the Last Updated date, DwellSoul does not sell personal information for money.

DwellSoul does not sell birth data or sensitive intake information.

If DwellSoul uses advertising or analytics tools that constitute “sale,” “sharing,” or targeted advertising under applicable privacy laws, we will provide required notices and opt-out methods, including a “Do Not Sell or Share My Personal Information” mechanism where required.

8. Cookies and Similar Technologies

We may use cookies, pixels, local storage, SDKs, and similar technologies to:

  • Process payments and subscriptions
  • Understand usage
  • Improve performance
  • Detect fraud or abuse

  • Account information: retained while your account is active and for a reasonable period after deletion for legal, security, and backup purposes.
  • Reports and saved homes: retained until you delete them, close your account, or request deletion, subject to legal and backup retention.
  • In-progress reading inputs: If you are signed in, we save unfinished reading answers to your account so you can resume later, including on another device. We delete these inputs after a limited period of inactivity, when you complete and save the reading, discard the draft, or close your account, subject to legal and backup retention.
  • Birth data and sensitive intake information: retained only as long as needed for the feature, saved profile, account, support, legal, security, or permitted de-identified analytics purpose.
  • Payment records: retained as needed for billing, tax, accounting, chargeback, and legal purposes.
  • Support messages: retained as needed to provide support and maintain business records.
  • Logs and security records: retained for a limited period unless needed for security, fraud, abuse, or legal investigation.
  • Backups: may retain deleted information for a limited period until overwritten according to backup cycles.

When information is no longer needed, we will delete, anonymize, de-identify, or otherwise handle it according to applicable law and our retention practices.

10. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

These measures may include:

14.1 United States State Privacy Rights

We collect these categories for the purposes described in this Privacy Policy, including providing the Service, processing payments, generating reports, securing the Service, improving the Service, communicating with you, and facilitating requested Partner introductions.

We do not knowingly sell personal information for money. We do not sell birth data. If we use advertising tools that constitute “sharing” under California law, we will provide required opt-out mechanisms.

14.2 European Economic Area, United Kingdom, and Switzerland

If GDPR, UK GDPR, or Swiss data protection law applies, you may have rights to:

If required by applicable law, DwellSoul will provide additional notices, obtain separate consent, implement cross-border transfer safeguards, or limit certain features for users in Mainland China.

Users in other jurisdictions may have additional rights under local law. We will honor applicable privacy rights where required.

The Service may not be available in all countries or regions. We may restrict access to certain features, payment methods, reports, Partner introductions, or data processing activities where legal, technical, payment, or compliance limitations apply.

15. Children’s Privacy

The Service is not directed to children under 13, and children under 13 may not create an account, use the Service, or submit personal information.

You must be at least 18 years old to create an account, purchase a paid plan, submit personal information, or use features requiring registration. Users under 18 may not create an account, purchase a paid plan, or submit personal information.

If we learn that we have collected personal information from a child under 13 without required parental consent, we will delete it as required by law.

Parents or guardians may contact us at legal@dwellsoul.comto request deletion of a child’s information.

16. Third-Party Services and Links

The Service may link to or integrate with third-party services, including:

Partners are independent third parties. If you request an introduction to a Partner, the Partner may contact you and collect additional information directly from you.

DwellSoul is not responsible for a Partner’s privacy practices, data security, services, advice, fees, or transaction conduct.

You should review the Partner’s privacy policy, terms, disclosures, licenses, qualifications, insurance, and service agreements before providing additional information or engaging the Partner.

18. User Responsibilities

You are responsible for ensuring that information you submit is lawful, accurate, and submitted with any required consent.

If you submit information about another person, including a spouse, family member, household member, client, customer, or property owner, you represent that you have permission or another lawful basis to submit that information.

If you are a real estate professional, consultant, designer, contractor, or other professional using DwellSoul with clients, you are responsible for your own privacy notices, consents, professional obligations, and compliance with applicable law.

19. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.

When we make material changes, we will update the “Last Updated” date and provide notice by email, through the Service, or by other reasonable means where required by law.

Your continued use of the Service after the updated Privacy Policy becomes effective means you acknowledge the updated policy.

20. Language; English Version Controls

This Privacy Policy and related privacy notices may be provided in English and in other languages. Any non-English version is provided for convenience only. To the extent permitted by applicable law, the English version will control if there is any conflict, inconsistency, ambiguity, or difference in interpretation between the English version and any translated version.

Nothing in this section limits any privacy rights, notice rights, consent rights, or language rights you may have under applicable law.
